Who is responsible

Lofty is a resource on downtown Toronto loft buildings. It is published under the 416spaces name by Kal Ayyoub, Realtor®, RARE Real Estate Brokerage. In this policy, "we" and "us" mean Kal Ayyoub and RARE Real Estate Brokerage.

Kal Ayyoub is accountable for how personal information is handled on Lofty and is the person to contact about it (see Contact). If you become a client, the brokerage's own privacy practices also apply.

We follow Canada's federal private-sector privacy law, the Personal Information Protection and Electronic Documents Act (PIPEDA), and Canada's Anti-Spam Legislation (CASL).

What we collect and why

We collect only what we need for the purpose shown. Anything not listed here, we do not collect.

You do not have to give us any personal information to read Lofty.

Cookies, analytics and security tools

Lofty does not use advertising or social-media tracking pixels, and does not build profiles of visitors.

To keep Lofty secure, prevent spam on our forms, and understand how the site is used, we use tools from third-party providers. When you load a page or use a form, your browser may connect directly to those providers' servers, and they may receive technical information such as your IP address, browser and device type, and signals used to tell people from automated traffic. We use these tools only for security, spam prevention and overall usage statistics. We do not use them for advertising or to follow you across other websites. The providers act on our behalf and handle this information under their own privacy notices.

Some of these tools may use cookies or similar browser storage that is strictly necessary for security or for the tool to work. We do not use cookies or similar technologies for advertising. You can block cookies in your browser settings, but security checks or forms may then stop working.

Weekly with Lofty: email, text and your consent

Weekly with Lofty is a weekly review of what is trading, what is new on the market, what has closed, and what has since moved, with commentary and statistics across the whole Lofty universe. You cannot pick individual buildings. Each week's report is also published as its own page on Lofty, and the link is emailed to you.

What you are agreeing to

When you tick the box on the sign-up form, you give us your express consent to email you Lofty listings, market updates and promotional material. Promotional material means information about the real estate services of Kal Ayyoub and RARE Real Estate Brokerage, such as invitations to talk about buying, selling or leasing. Nothing on the form is ticked in advance, and you can use Lofty without signing up.

Optional: a text with the link

The form also has a separate, unticked box and a mobile number field if you would like us to text you the link to each week's report. It is optional, and you do not need to give a mobile number to get the email. If you tick it, we send one text a week with the link. Your mobile carrier may charge its usual message and data rates. Reply STOP to any text to end texts; that ends texts only, and your email continues until you unsubscribe from it.

What every message includes

Each email identifies Kal Ayyoub and RARE Real Estate Brokerage, gives our mailing address and a way to contact us, and has an unsubscribe link that works without logging in. Each text names us and how to stop it, and links to a page with our full contact details.

Withdrawing consent

Use the unsubscribe link in any email, reply STOP to any text, or write to kal@416spaces.com. We act on requests as fast as our systems allow and always within 10 business days, at no cost to you.

Email tracking

Our email service records whether an email was opened and whether its links were clicked. We use this only to see how many people read the report, not to build a profile of you.

If you write to us

If you send us a question, we will reply. Replying does not add you to any list, and we will not send marketing messages unless you have opted in.

Records

We keep a record of each consent so we can show when and how you gave it. The retention period is in the table above.

Who we share it with

We share personal information only with:

• Service providers that act on our behalf and may use the information only to provide their service: our website host and network provider, the providers of the security, spam-prevention and analytics tools described under Cookies, analytics and security tools, our email service (Microsoft 365), our email-sending provider, our text-message provider (if texts are offered), and our sign-up form or contact-management tool.
• RARE Real Estate Brokerage, for brokerage record-keeping and supervision, if you contact us about a transaction or become a client.
• Regulators, courts and other authorities, where the law requires it or where the Real Estate Council of Ontario (RECO) asks for records it is entitled to.

We do not sell, rent or trade your information, and we do not give it to other agents, lenders, developers or advertisers.

Where information is stored

Some of our service providers store or process information outside Canada, including in the United States. Information held in another country is subject to that country's laws and may be accessible to its courts and authorities.

Keeping it safe

We limit who can see subscriber and contact information, use access controls with our service providers, and keep only what the table above lists. No system is perfectly secure.

If a breach of our safeguards creates a real risk of significant harm to you, we will tell you and report it to the Office of the Privacy Commissioner of Canada as the law requires.

Your rights

You can ask us to:

• tell you what personal information we hold about you and how we have used it;
• correct information that is wrong;
• delete your information, or stop using it for a purpose you no longer agree to; and
• withdraw a consent you gave.

Write to us at the address in Contact. We may need to confirm who you are first. We aim to answer within 30 days. Some records must be kept by law, and we will tell you if that limits your request.

Complaints

Please raise any concern with us first so we can try to fix it. You can also contact:

• the Office of the Privacy Commissioner of Canada, for privacy complaints;
• the Spam Reporting Centre, if you think you received a commercial email or text without valid consent; and
• the Real Estate Council of Ontario, for concerns about the conduct of a real estate registrant.

Children

Lofty is meant for adults. We do not knowingly collect personal information from anyone under 18. If you believe a young person has given us information, contact us and we will delete it.

Links to other sites

Lofty links to other sites, including our social media profiles and the brokerage's website. Their privacy practices are their own, and this policy does not cover them.

Changes to this policy

We will post any change here and update the date at the top. If we change what we do with information you have already given us, we will ask for your consent again where the law requires it, and we will email subscribers about material changes.
